7:30 pm Request for Emergency Certification, Wayne McCormack Map 48 Parcel 39 370 East St., Mike Kulig, Berkshire Engineers.

Site visit was held on August 19, 2009 and attended by NC, VA, TF, JS, DL, RFC and Mike Kulig.

Mr. Kulig was present to make the request.  There has been a breach of a dam, leaving residual debris which has created extensive erosion threatening two separate dwellings on either side of the brook.  The plan is to stabilize the bank and utilities.

RFC made a motion to grant the emergency certificate and VA seconded the motion.  The Commission voted to agree 5-0-1 with DL abstaining.  

Notice of Intent, Richard Heiss, Sargent Brook Road, Map 1 Lot 2 of Parcel 35.  Continue to mow an existing 6’ wide grass path through the buffer zone and BVW to Laurel Lake; mow a 12’ by 12’ sitting area; install a boat rack, 2 pipes for attachment of removable floating dock, weed-whack parcel two times a year and remove invasive shrubs. Continued from August 21, 2008, September 4, 2008, September 18, 2008, October 2, 2008, December 18, 2008, March 19, 2009, April 16, 2009, June 4, 2009, July 16, 2009, August 20, 2009.  It was agreed by the Commissioners that a letter be sent to both Gail Ceresia and Richard Heiss advising that this meeting has been continued to September 3, 2009 and that if the applicants do not comply with the Commission’s request of the August 20, 2008 hearing, the Commission will vote on the Notice of Intent.  

Other business:
·       NC inspected and approved the silt fence at 439 Pittsfield Rd., Map 33 Portion of
Parcel 1.  
·       916 East New Lenox Rd., General Electric property demo permit was approved for three barns.   
·       Rob Hoogs will be in for Fire Tower Road in the near future.
·       MASS Audubon will be presenting a NOI on Sept. 3, 2009

Jeannette van Lingen, 135 Laurel Lake Road, House at Edith Wharton Park, Letter received today, August 20, 2009   (dated July 10, 2009) from Mrs. van Lingen advising that she has made arrangements to move to Lenox Housing and will be vacating the premises on or before September 1, 2009.  PA spoke to Town Manager Greg Federspiel prior to this meeting regarding the letter and he stated that he wants to coordinate an inspection of the home with Lee Town Manager Bob Naseman, and a member of the Commission if they so choose. It was decided that the Commission would refer this to Mr. Federspiel for coordination and that Neal Carpenter will attend the inspection.  PA will respond to Ms. van Lingen’s letter.  (On August 21, 2009, PA advised Mr. Federspiel that she has responded to Ms. van Lingen and advised her that Mr. Federspiel will be her contact and will coordinate an inspection with the Lee Town Manager.)

NHESP Tracking No. : 04-165, for Massachusetts Audubon Society, received August 20, 2009.  Letter states that this project meets the state-listed species performance standard for the issuance of an Order of Conditions.

Minutes:  August 6, 2009 DL made a motion to approve the minutes and JS seconded the motion.  The Commission voted to approve 6-0.

Robert and Nancy Sitzer, 152 Plunkett St., Map 3 Lot 75.  Extend Order of Conditions.

VA made a motion to extend the Order of Conditions which was issued on September 21, 2006 for three years.  TF seconded the motion.  The Commission voted to extend 6-0.

RFC made a motion to adjourn at 8:25 pm.  VA seconded the motion and the Commission voted to adjourn 6-0.
